O presente artigo tem por objetivo destacar a importância da felicidade dentro do sistema moral kantiano, mesmo que ela esteja baseada nos sentimentos de prazer e desprazer, ou seja, proveniente da ordem empírica. Para isso, faz-se necessário diferenciar deveres diretos de deveres indiretos, ou seja, os primeiros como deveres perfeitos que são obrigatórios e necessários, e os últimos como imperfeitos, que dizem respeito simplesmente àquilo que é bom que se faça, por isso são altamente recomendáveis. Os deveres indiretos ou imperfeitos, (...) que nada mais são do que deveres de virtude, somente tendem a acrescentar à qualificação moral. O dever indireto de promover a felicidade coloca-se, na filosofia prática de Kant, como um meio para a moralidade, visto que a falta de felicidade pode apresentar-se como um obstáculo à prática moral e não o contrário. As AI Systems become increasingly autonomous, they are expected to engage in decision-making processes that have moral implications. In this research we integrate theoretical and empirical lines of thought to address the matters of moral reasoning and moral uncertainty in AI Systems. We reconceptualize the metanormative framework for decision-making under moral uncertainty and we operationalize it through a latent class choice model. The core idea being that moral heterogeneity in society can be codified in terms of a small number of (...) classes with distinct moral preferences and that this codification can be used to express moral uncertainty of an AI. Choice analysis allows for the identification of classes and their moral preferences based on observed choice data. Our reformulation of the metanormative framework is theory-rooted and practical in the sense that it avoids runtime issues in real time applications. To illustrate our approach we conceptualize a society in which AI Systems are in charge of making policy choices. While one of the systems uses a baseline morally certain model, the other uses a morally uncertain model. We highlight cases in which the AI Systems disagree about the policy to be chosen, thus illustrating the need to capture moral uncertainty in AI systems. (shrink)

The history of East Timor has gone through several moments of transformation due to human actions that have the presence of Portuguese, Japanese, Indonesians and different social groups and local kingdoms. With this, one can note the trend of the evolution of thinking, arising from education in philosophy and its contribution to the changes that were seen as necessary, were initial instruments for Timor to become a republic, not explored, but as an autonomous people. Thus, the aim of this article (...) is to present a reflection on the role of philosophy in the history of the Timorese society. Thus, philosophy should not be understood only with a mere sense of individualistic self-construction, or even an incorporation of circumstantial urgencies, but rather with regard to a content that must be taught and learned, given that there are languages and methods and that, with due importance, understanding is built, also developing more doubts and, thus, the philosophical character of national thought. However, it is necessary to recognize the assumption that philosophical themes were established according to universal terms, with Universal approaches and incorporated with the urgencies of each place. Thus, even the themes with a challenging nature, there was still Timorese philosophical expression of clear importance for the development of a national idea, so that philosophy is present and is still discussed in all periods that make up the National History. In that regard, this article will offer in the first part an introduction, second philosophy, third history, fourth nation building, fifth the history of struggle for national liberation and will be end with final consideration. This article will address Edith Stein's interests in relation to the microcosm of man, whether as a material, living, animated or spiritual body, as well as in his social, historical, community and cultural position. For Edith Stein, only through this set of interrelated and exclusive instances, each with its own particularities and yet dependent on the others. The phenomenological study of the SELF presented by the author, in the search for the Divine, for awareness of “character”, in the experience of (...) each part of one's own being, in experience, in empathy, where through philosophical anthropology Edith Stein conceives everyone as living beings, with man as a microcosm. For this reason, in the first part it will be discussed regarding The Centrality of the Body in Stein's Philosophical Anthropology. It has become a necessity within anthropology to refer to the body/empathy element. These two realities are established as essential in Stein's considerations and they are what will determine the scope of what refers to the empathic process and the Constitution of the self, elements so necessary for the recovery of the affirming reality of the human in its specification’s man/woman. In the second stage will address about the Soul and Spirit in Stein's Philosophical Anthropology. The living body is established in the fact that in addition to possessing external sensory characteristics, which can be grasped by consciousnesses, they themselves are holders of the ability to feel. Stein postulates as the first characteristic of the experienced body The Binding of the latter to an individual consciousness, to a subject. In his doctoral work, Stein turns to the characterization of an individual who has an essence that is established not only in the corporeal-psychic dimension, but also in that of spiritual appreciation. In this paper I defend the “Standard View” of the semantics of ‘I’—according to which ‘I’ is a pure, automatic indexical—from a challenge posed by “deferred reference” cases, in which occurrences of ‘I’ are (allegedly) not speaker-referential, and thus non-automatic. In reply, I offer an alternative account of the cases in question, which I call the “Description Analysis” (DA). According to DA, seemingly deferred-referential occurrences of the first person pronoun are interpreted as constituents of a definite description, whose operator scopes (...) over an open sentence Rxy—where R is a contextually selected relation ranging over pairs of people and objects. The role of intentions is thus limited to the determination of R, which is posterior to the fixation of the reference of ‘I’. In support of the DA I present evidence that, in the cases in question, the (Determiner) phrase containing ‘I’ behaves in relevant ways like a description. I show that the DA can account for the problematic examples, while preserving the simplicity of the standard semantics of ‘I’. Finally, I examine a rival account of the data, offered by Nunberg (Linguist Philos 16:1–43, 1993), and argue for the superiority of the DA. (shrink)

Artificial Intelligence (AI) is set to bring changes to legal systems. These technologies may have positive practical implications when it comes to access, efficiency, and accuracy in Justice. However, there are still many uncertainties and challenges associated with the implementation of AI in the legal space. In this research, we surveyed Judges on critical challenges related to the Judging Profession in the AI paradigm; Automated Adjudication; and Legal Principles. Our results suggest that (i) Judges are hesitant about changes in their (...) profession. They signal the need for adequate training that fosters legal literacy in AI, but are less open to changes in legal writing or their social and institutional role; (ii) Judges believe higher levels of automation only lead to fair outcomes if used in earlier phases of adjudication; (iii) Judges believe and are concerned about AI leading to Techno-Legal Positivism; and (iv) Judges consider that Legal AI technologies may have a positive impact in some legal principles, as long as everyone has equal access to those technologies and cybersecurity and judge on the loop safeguards are in place; and (v) Judges are strongly concerned about the de-humanization of Justice. They consider that assessing evidence, analyzing arguments, and deciding on a legal case should be inherently human. By surveying these practitioners, we aim to foster a responsible, inclusive, and transparent innovation in Justice. (shrink)

Moral distress has been characterised as one of the main ethical problems affecting nurses in all health systems, and has been depicted as a threat to nurses’ integrity and to the quality of patient care. In recent years, several studies tried to investigate moral distress, its causes and consequences for health professionals, clients and organisations. However, such studies are considered controversial and vulnerable, mainly because they lack a solid philosophical and empirical basis. The present article aimed at elaborating a theoretical (...) model for moral distress, considering the process of moral deliberation, spaces of power and resistance and patient advocacy, and sought to carry out a reflection that culminated with the creation of a broader concept of moral distress. Ethical issues flow from and are embedded in contexts of practice. Contexts of practice refer to the diverse social settings where interventions occur. Primary prevention activities require new professional roles in these diverse social settings. These new roles engage the professional in new activities, which in mm allow new ethical issues to arise. This article takes an ecological perspective on ethical issues arising from the enactment of new preventive roles intended to affect groups or communities. Within this perspective, the concepts (...) of context and culture take on special conceptual significance. Four ecological assumptions about preventive interventions intended to affect groups or communities are offered as a means of framing ethical issues in such interventions. Finally, several approaches to developing ecological knowledge about the contexts of practice are presented as ways of furthering our ability to conceptualize and cope with ethical issues in preventive interventions intended to affect groups or communities. Este trabalho busca discutir, a partir de dados obtidos em trabalho de campo etnográfico coletivo multissituado, elementos de uma cultura comunicacional dos torcedores no Brasil. Tradicionalmente tratados como coletivo, massa, povo ou multidão pelos meios de comunicação tradicionais, a abordagem proposta evidencia, nas falas dos próprios torcedores, uma compreensão sofisticada do universo afetivo, familiar, econômico e político que envolve o torcer por uma equipe de futebol no Brasil contemporâneo.

I review and challenge the views on simplicity and its role in linguistics put forward by Ludlow. In particular, I criticize the claim that simplicity—in the sense pertinent to science—is nothing more than ease of use or “user-friendliness”, motivated by economy of labor. I argue that Ludlow’s discussion fails to do justice to the diversity of factors that are relevant to simplicity considerations. This, in turn, leads to the neglect of crucial cases in which the rationale for simplification is unmistakably (...) epistemic, as well as instances where simplicity is part of the content of substantive, empirical hypotheses. I illustrate these points with examples from the history of generative linguistics, such as: the shaping influence exerted by simplicity, via its involvement in the notion of “linguistically significant generalization”, its methodological and substantive contribution to the goal of explanatory adequacy, and its central role in the Minimalist Program’s search “beyond explanatory adequacy”. En este artículo desarrollo una objeción a PAV, llamada �el reto de la integración�, originalmente propuesto por Stich (1978) y Evans (1981), y que está constituido por dos premisas: (1) las actitudes proposicionales se caracterizan por su integración inferencial, y (2) los estados que contienen información gramatical no están inferencialmente integrados. Proponho comparar e aproximar as fundamentações normativas para o socialismo de Axel Honneth e John Rawls. Parto, para tanto, de alguns traços da teoria de Honneth desenvolvidos em seu escrito sobre socialismo e dos próprios contrastes estabelecidos por ele frente ao projeto de Rawls. Destrincho a comparação em duas frentes: a primeira, tratando do conteúdo normativo das noções de liberdade de ambos os autores, a segunda, tratando do que Honneth e outros autores da tradição da teoria crítica chamam de base (...) social ou imanente das teorias. Da primeira, concluo que o contraste estabelecido por Honneth entre o seu ideal de liberdade social e o ideal de liberdade encontrado na filosofia política de Rawls não encontra respaldo em uma análise acurada da proposta rawlsiana, e que a filosofia de Rawls também pode fornecer uma normatividade crítica para o Socialismo. Da segunda, concluo, a despeito da crítica de Honneth de que haveria uma deficiência ‘prático-política’ na filosofia de Rawls, que é possível encontrar na obra deste, de uma forma mais ou menos similar àquela do autor alemão, os três elementos que Honneth julga serem necessários para uma teoria crítica que não queira ser apenas uma crítica ‘puramente normativa’ da sociedade. The analysis of fundamental texts such as “Architecture and Narrativity” and Memory, History, Forgetting aims to fill a gap in studies of Environmental Hermeneutics. Indeed, the analogy between space and narrative, through parallelism with the process of triple mimesis, is usually deduced by environmental hermeneuticists from the works Time and Narrative and Oneself as Another. However, Ricœur himself took it upon himself to make this transposition in a direct and elaborated way from a phenomenological and hermeneutic analysis of the built (...) space and the inhabited space, opening the way for a broader and more grounded epistemology of environmental hermeneutics. The introduction of the critical concept of landscape, as seen today by constructivist and cultural geography, legitimizes the claims of an environmental hermeneutics as an interpretive process of formally non-textual objects. Indeed, landscape in its connection to territory has its own semiotic and semantic character, which is appealed to for reading and interpretation. (shrink)

Ce qui nous amène à insérer le texte de Thucydide dans la séquence des trois phases de la mimésis impliquée dans toute mise en discours : préfiguration, configuration, refiguration. Le dialogue que nous établissons entre le philosophe français et l’historien grec (...) nous permet aussi de trouver plusieurs dissimilitudes et similitudes entre les deux, soit en réfléchissant sur la question de la vérité, soit en réfléchissant sur la dialectique entre lire et voir, sous le signe du concept rhétorique de l’ enargeia. Background Compulsory treatments represent a legal means of imposing treatment on an individual, usually with a mental illness, who refuses therapeutic intervention and poses a risk of self-harm or harm to others. Compulsory outpatient treatment in psychiatry, also known as community treatment order, is a modality of involuntary treatment that broadens the therapeutic imposition beyond hospitalization and into the community. Despite its existence in over 75 jurisdictions worldwide, COT is currently one of the most controversial topics in psychiatry, and it (...) presents significant ethical challenges. Nonetheless, the ethical debate regarding compulsory treatment almost always stops at a preclinical level, with the different ethical positions arguing for or against its use, and there is little guidance to support for the individual clinicians to act ethically when making the decision to implement COT. Main body The current body of evidence is not clear about the efficacy of COT. Therefore, despite its application in several countries, evidence favouring the use of COT is controversial and mixed at best. In these unclear circumstances, ethical guidance becomes paramount. This paper provides an ethical analysis of use of COT, considering the principlist framework established by Ross Upshur in 2002 to justify public health interventions during the 2002–2004 severe acute respiratory syndrome outbreak. This paper thoroughly examines the pertinence of using the principles of harm, proportionality, reciprocity, and transparency when considering the initiation of COT. Conclusion Ross Upshur’s principlist model provides a useful reflection tool for justifying the application of COT. This framework may help to inform sounder ethical decisions in clinical psychiatric practice. (shrink)

The aim of this paper is to provide an approach to the etho-aesthetic dimension in Marcuse’s thought. The approach in this paper is built upon the following thesis: the etho-aesthetic dimension consists of the transformation of subjectivity based on artistic sensitivity and critical rationality from which social relations opposed to an advanced industrial society and its one-dimensional man are reconstructed materially and intellectually. The conclusion is the following: a Marcusian critical theory, inherited from Marx and Schiller, would be one capable (...) of analyzing the potential qualitative changes of the subjects and social institutions to generate a higher level of rational development, equitable in the distribution of resources and in the generation of greater spaces of freedom. Abstrak: Filsafat telah memiliki perjalanan panjang dalam hubungannya dengan Kristianitas. Sumbangan filsafat untuk Kristianitas begitu banyak terutama dalam kaitannya dengan teologi. Tulisan ini meneliti soal integrasi filsafat dalam Kristianitas yang selama ini sering diperdebatkan. Periode apologi yang dimulai pada awal abad kedua sampai dengan pertengahan abad ketiga Masehi, memberikan suatu penjelasan konkrit untuk permasalahan ini. Melalui para apologet, yang sebelumnya adalah filsuf, bahkan mampu melangkah lebih jauh dalam penemuan kebijaksanaan yang sesungguhnya yang merupakan obyek dan tujuan filsafat. Bahkan mereka sampai (...) pada suatu pemikiran bahwa filsafat adalah ranah semai yang mempersiapkan filsafat yang sesungguhnya, yaitu Kristianitas. Berkat para apologet, filsafat menjadi bagian penting dalam Kristianitas, bukan saja di bidang teologi, tetapi juga di dalam ranah eksegese, hermeneutika dan terlebih-lebih di dalam hidup. Penulis Kristiani setelah periode apologi mengintegrasikan filsafat dalam tulisan dan di dalam rumusan iman. Berbagai terminologi filosofis yang diintegrasikan ke Kristianitas belum tergantikan sampai dengan saat ini. Kata-kata Kunci: Filsafat, filsuf, teologi, apologi, apologet, kebijaksanaan. Abstract: Philosophy is having a long journey in its relationship with Christianity. There is much influence of philosophy on Christian thinking, but especially on theology. This article researches the integrity of philosophy within Christianity, an integral relationship which has always been debated. During the period of the Apologies, which was begun at the beginning of the second century up to the middle of the third century, an important concrete solution to this debate was given. Through the Apology Fathers of the Church who previously were philosophers, had the capacity to go farther in finding real wisdom, which is the subject and the goal of all research in philosophy. They were able to reach a consideration that their philosophy was a field seed which had prepared for the real philosophy, which is Christianity. Through the apologies, philosophy created an important partnership with Christianity in the areas of theology and biblical exegeses, and even in hermeneutics and way of life. After the period of the Apology Fathers, Christian writers integrated philosophy in a certain way into their writings, even as a formula of faith. Research and intervention involving primary prevention have grown dramatically in the past 10 years. However, little attention has been paid to ethical issues in primary prevention. This article proposes a framework for increasing awareness of such issues. The framework centers on explicating the contexts where prevention activities occur and the roles adopted by interventionists engaging in these activities. Several assumptions underlying primary prevention are stated, and ways of clarifying ethical issues are proposed.

This article deals with the cognitive relationship between a speaker and her internal grammar. In particular, it takes issue with the view that such a relationship is one of belief or knowledge (I call this view the ‘Propositional Attitude View’, or PAV). I first argue that PAV entails that all ordinary speakers (tacitly) possess technical concepts belonging to syntactic theory, and second, that most ordinary speakers do not in fact possess such concepts. Thus, it is concluded that speakers do not (...) literally ‘know’ or ‘believe’ much of the contents of their grammars, and moreover, that these contents can only be attributed at a subpersonal level. A key challenge for understanding transcriptional regulation is being able to measure transcription factor (TF)‐DNA binding events with sufficient spatial and temporal resolution; that is, when and where TFs occupy their cognate sites. A recent study by Para et al. has highlighted the dynamics underlying the activation of gene expression by a master regulator TF. This study provides concrete evidence for a long‐standing hypothesis in biology, the “hit‐and‐run” mechanism, which was first proposed decades ago. That is, gene expression is dynamically (...) controlled by a TF that transiently binds and activates a target gene, which might stay in a transcriptionally active state after the initial binding event has ended. Importantly, the experimental procedure introduced, TARGET, provides a useful way for identifying multiple target genes transiently bound by their regulators, which can be used in conjunction with other well‐established methods to improve our understanding of transcriptional regulatory dynamics. These languages are comparable in expressive power to the $[Unrepresented Character]_{T}$ -type, truth-theoretic languages first considered by. Kripke, yet each of our $[Unrepresented Character]_{M,T}$ -type languages possesses the additional advantage that, within it, the meaninglessness of any given meaningless expression can itself be meaningfully expressed. When a widely reused ontology appears in a new version which is not compatible with older versions, the ontologies reusing it need to be updated accordingly. Ontobull has been developed to automatically update ontologies with new term IRI(s) and associated metadata to take account of such version changes. To use the Ontobull web interface a user is required to (i) upload one or more ontology OWL source files; (ii) input an ontology term IRI mapping; and (where needed) (iii) provide update (...) settings for ontology headers and XML namespace IDs. Using this information, the backend Ontobull Java program automatically updates the OWL ontology files with desired term IRIs and ontology metadata. The Ontobull subprogram BFOConvert supports the conversion of an ontology that imports a previous version of BFO. A use case is provided to demonstrate the features of Ontobull and BFOConvert. El estudio del patrimonio como fenómeno sociocultural exige prestar atención a cuáles son las representaciones que elabora y hace circular socialmente. En el caso de este artículo, el problema identificado consiste en que las reseñas históricas utilizadas en la difusión de ciudades históricas y patrimoniales pudieran estar representando negativamente a los pueblos indígenas, colaborando en la reproducción de representaciones tendenciosas. De esta manera, el objetivo de este artículo es conocer las valoraciones realizadas a los pueblos indígenas en las reseñas históricas, (...) realizándose un estudio de caso de la ciudad de La Serena (Chile). Para llevarlo a cabo, se recurre teóricamente a los Estudios Patrimoniales y a los Estudios Críticos del Discurso, optando por la arquitectura teórica de la Lingüística Sistémico-Funcional que, valiéndose del Sistema de Valoración, permite indagar sobre los efectos retóricos que construyen posicionamientos ideológicos en los discursos. Se concluye que las reseñas estudiadas poseen un posicionamiento ideológico tradicional de la historia, ya que el relato se presenta como una historia de héroes hispanos que enfrentan grandes gestas contra los indígenas, cuya participación queda descontextualizada y reducida a la destrucción de la ciudad y la oposición a los españoles. O presente artigo propõe-se a realizar um estudo comparado, eminentemente teórico, entre os critérios materiais para determinação do bem jurídico nas teorias normativas do direito de John Finnis e de Martha Nussbaum, com fito a apresentar o modo de fundamentação e o conteúdo das listas propostas por cada um dos autores. Inicialmente, o estudo discutirá os bens humanos básicos em Finnis. Após, as capacidades em Nussbaum. In normative terms, human dignity usually implies two consequences: human beings cannot be treated in some particular ways due to their condition as humans; and some forms of life do not correspond to the ideal life of our community. This study consists in discussing the meaning of this idea of human dignity in contrast to the concept of humiliation in the context of institutional, i.e. political and legal, rights. Two concepts of human dignity will be discussed. The first absolute/necessary and (...) formal/transcendental concept implies the proposition “because human beings have dignity, the following cluster of rights is valid”. Conversely, the second contingent and material concept corresponds to the thought “for being able to live in dignity, we must respect the following rights”. This paper claims that human dignity should be understood as the right to be protected from humiliation. Humiliation is the situation of incapacity or absence of self-determination. (shrink)

Se propone que la propuesta de la nueva línea programática “Más que nunca” del Museo de la Memoria y los Derechos Humanos reconfigura la temporalidad de la exhibición permanente, uniendo las movilizaciones en dictadura y en democracia bajo un mismo proceso cuyo horizonte es el logro de una “democracia plena”, dotando de significado histórico y re-politizando la lucha por los Derechos Humanos en el presente. El artículo hace un análisis del discurso de Beccaria contenido en su libro Dei delitti e delle pene y extrae las ideas relativas a la percepción como argumento considerable dentro de su propuesta político-criminal para fundar la utilización de ciertos instrumentos de la penalidad, con base en su pensamiento sobre la estética, entendida como un estudio sobre la percepción, realizado en algunas investigaciones personales. Igualmente, toma ciertas ideas de la epistemología gravitante de la época, para fundar su desiderátum político-criminal.
